Please read these Terms and Conditions (“Terms”, “Terms and Conditions”) carefully before using the website gscarbooking.com (the “Website”) and associated mobile applications operated by Gangasagar Car Booking (“we”, “us”, “our”, “Company”).
By accessing or using our Website and services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
1. Definitions
- “Service” refers to the car booking and transportation services provided through our platform.
- “User” or “Customer” refers to any person who accesses or uses the Website or mobile application to book or inquire about car rental services.
- “Car Owner” refers to third-party vehicle owners who list their vehicles on our platform.
- “Driver” refers to the assigned driver for a confirmed booking.
- “Booking” refers to a confirmed reservation of a vehicle made through our platform.
2. Nature of Service
Gangasagar Car Booking operates as a marketplace platform that connects travellers with local car owners and drivers on Gangasagar Island (Sagar Island), South 24 Parganas, West Bengal, India. We do not own the vehicles listed on our platform. The vehicles are owned and operated by independent third-party car owners.
3. Booking Terms
- All bookings are subject to vehicle availability.
- A booking is considered confirmed only after successful payment (full or partial advance) and confirmation by our team.
- Bookings that are not confirmed by our team within 24 hours (or the configured expiry period) may be automatically cancelled.
- You must provide accurate personal information including name, phone number, and email address during booking.
- You must be at least 18 years of age to make a booking.
- We reserve the right to refuse or cancel a booking at our sole discretion if we suspect fraud, misuse, or violation of these Terms.
4. Routes
We currently serve three routes: Kachuberia to Gangasagar, Benuban to Gangasagar, and Mayagoalini Ghat to Gangasagar. The distances, estimated travel times, and fares are approximate and may vary depending on road conditions, weather, and traffic.
5. Pricing and Payment
- All prices are listed in Indian Rupees (INR, ₹) and include applicable taxes unless stated otherwise.
- Prices may vary based on the route, car type, trip type (one-way or round trip), and seasonal demand (e.g., Gangasagar Mela).
- The final fare displayed at the time of booking is the fare you will be charged. There are no hidden fees.
- Payments are processed securely through Razorpay. We accept UPI, credit/debit cards, net banking, and wallets.
- We offer two payment options: (a) Full Payment — pay the entire amount at the time of booking; (b) Partial Payment — pay a minimum advance amount to secure your booking and pay the remaining balance later.
- The minimum advance amount varies by route and car type and is displayed during the booking process.
- For partial payment bookings, the remaining balance must be paid either online or directly to the driver before or during the trip.
6. Cancellation by Customer
- You may request cancellation of your booking by contacting us via phone (9382730553 / 7063190879) or WhatsApp.
- Cancellations are processed manually by our admin team.
- Cancellation eligibility and refund amounts depend on when the cancellation request is made relative to the pickup date and time.

7. Cancellation by Company
We reserve the right to cancel a booking under the following circumstances:
- Vehicle breakdown or unavailability due to unforeseen circumstances.
- Natural disasters, extreme weather, government restrictions, or force majeure events.
- Suspected fraud or violation of these Terms by the Customer.
In case of company-initiated cancellations, a full refund will be processed to the Customer.
8. Refund Policy
- Refunds are processed within 5-7 business days after approval.
- Refunds are credited to the original payment method used during booking.
- Partial payment advance may be non-refundable in certain circumstances. See our Refund and Cancellation Policy.
9. Passenger Responsibilities
- Passengers must be present at the designated pickup point at the agreed date and time.
- Passengers must carry valid photo identification.
- Passengers are expected to behave respectfully towards the driver and maintain the cleanliness of the vehicle.
- Smoking, consumption of alcohol, and carrying illegal substances in the vehicle is strictly prohibited.
- Any damage to the vehicle caused by the passenger will be the passenger’s financial responsibility.
- Passengers are responsible for their own belongings. We and the car owners/drivers are not liable for any loss or theft of personal items.
10. Luggage
Standard luggage (1-2 bags per passenger) is included. Excess luggage must be mentioned during booking. The driver reserves the right to refuse excessive luggage that does not fit safely in the vehicle.
11. Children
Children are welcome and travel free of charge. However, they count towards the total passenger capacity. Parents or guardians are responsible for their children throughout the journey. Child safety seats are not provided by default — please bring your own if needed.
12. Liability
- As a marketplace platform, Gangasagar Car Booking acts as an intermediary and is not directly responsible for the actions, omissions, or negligence of car owners or drivers.
- We are not liable for delays, cancellations, or service failures caused by factors beyond our control, including but not limited to road conditions, weather, natural disasters, government orders, mechanical breakdowns, or strikes.
- Our total liability, if any, shall be limited to the amount paid by the Customer for the specific booking in question.
- We do not guarantee the condition, safety, or roadworthiness of any vehicle listed on our platform, though we make reasonable efforts to verify our providers.
13. Force Majeure
We shall not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including natural disasters, floods, cyclones, epidemics, pandemics, war, government restrictions, strikes, road blockages, ferry service disruptions, or any other event constituting force majeure.
14. Intellectual Property
All content on the Website, including text, images, logos, graphics, and software, is the intellectual property of Gangasagar Car Booking and is protected under applicable Indian intellectual property laws. You may not reproduce, distribute, or use our content without our prior written consent.
15. Privacy
Your use of our services is also governed by our Privacy Policy. By using our services, you consent to the collection and use of your personal information as described therein.
16. Disputes and Governing Law
- These Terms shall be governed by and construed in accordance with the laws of India.
- Any disputes arising out of or in connection with these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts in South 24 Parganas, West Bengal, India.
- We encourage you to contact us first to resolve any disputes amicably before pursuing legal action.
17. Modifications
We reserve the right to modify or update these Terms at any time without prior notice. Changes will be effective immediately upon posting on this page. Your continued use of our services after any modifications constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
18. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
